Kentucky Medical Program to Launch in 2025


In early 2023, Kentucky’s governor Andy Beshear signed Senate Bill 47, which legalizes medical cannabis in the commonwealth effective Jan. 1, 2025. Regulations are still being ironed out by the governor and new Kentucky Medical Cannabis Program department, but promising signs are ahead.

 
 

One example of such promising signs is House Bill 829, which if passed would immediately accelerate the program, with licensing occurring this summer to assure Kentucky’s medical patients had access to medical cannabis by early 2025. Other Bills, such as Senate Bill 47, would significantly increase the number of qualifying medical conditions that allow patients medical cannabis access.

 

Under the currently passed legislation various types of cannabis licenses will be available, including:

  • Tier I Cultivator (2,500 sq. ft.)

  • Tier II Cultivator (10,000 sq. ft.)

  • Tier III Cultivator (25,000 sq. ft.)

  • Tier IV Cultivator (50,000 sq. ft.)

  • Dispensary

  • Processor

    • A business which prepares, manufactures, and packages medical cannabis products.

  • Producer

    • A business which is both a cultivator and a processor.

  • Safety Compliance Facility

    • Responsible for testing medical cannabis products produced in Kentucky to ensure those products are safe for consumption and use.
